An excerpt from the latter section reads:
'The Court of Appeal held: It would not decline to follow the decision in Nolan v Emo Oil Services Ltd  IEHC 15 and that line of authority, as invited, still less find that it had been wrongly decided. Apart from being satisfied that Nolan was correct in the light of the statutory code that had been provided by the Oireachtas for dealing with the type of issues that the appellant had sought to raise, it would be entirely inappropriate to do so on an interlocutory application. Nolan was by now firmly embedded in the jurisprudence in this area.'
